TOWN OF DEER TRAIL, COLORADO BOARD OF TRUSTEES Special Meeting February 24, 2006
CALL TO ORDER
The Board of Trustees of the Town of Deer Trail met in special session on Friday, February 24, 2006 at the Town Hall, 555 Second Avenue, Deer Trail, Colorado. Mayor Jim Johnson called the meeting to order at 10:00 a.m. The purpose of the meeting was to discuss Dangerous Buildings, Code Enforcement, and Cost Recovery Agreement with East Bijou Estates. ROLL CALL Mayor: Jim Johnson TrusteesPresent: Gary Lavoie, Russell Ness, Tami Stoumbaugh, Melvin Wood Staff Present: Patti Owens, Town Clerk; Randy Eldringhoff, Maintenance; Stan Kimble, Town Attorney COST RECOVERY AGREEMENT
Discussion on the Cost Recovery Agreement was moved to this position on the agenda. The Board discussed several items with Attorney Stan Kimble and Glenn Kunkel from East Bijou Estates including administrative costs of collection of the recovery fees by the Town within the building permit process. Stan Kimble will check with the Town of Limon and the Town Clerk will check with the Town of Bennett to see how they handle administrative collection costs, if any. Invoices for development submitted by East Bijou Estates will be reviewed. Glenn Kunkel will change some formulas in the draft agreement. Further discussion on the Cost Recovery Agreement will be held at the March 7, 2006 regular Board meeting. DANGEROUS BUILDINGS Based upon Findings and Order of municipal judge Dorothy Stone, the building at 692 First Avenue, owned by A & M Land Company, has been deemed dangerous as defined by Deer Trail's Ordinance 212. TRUSTEE LAVOIE MOVED, TRUSTEE T. STOUMBAUGH SECONDED to direct the Town Attorney to continue necessary procedures regarding the dangerous building at 692 First Avenue, as well as contact the attorney of the property owner to inquire about the possibility of the Town taking title at this time and acquire a title commitment, while the Town solicits bids for demolition. Voting was as follows: YES: Johnson, Lavoie, Ness, T. Stoumbaugh, Wood NO: None ABSTAIN: None ABSENT: C. Stoumbaugh, Venter The Mayor declared the motion carried. TRUSTEE T. STOUMBAUGH MOVED, TRUSTEE NESS SECONDED to direct the Town Attorney to continue necessary procedures regarding the dangerous building at 376 First Avenue, as well as contact the attorney of Sharla Kontour to ask if she will deed her interest in the property to the Town and remove the child support judgment and Deed of Trust and ask Joseph Reigle to deed his interest in the property to the Town, while the Town solicits bids for demolition. Voting was as follows: YES: Lavoie, Ness, T. Stoumbaugh, Wood, Johnson NO: None ABSTAIN: None ABSENT: C. Stoumbaugh, Venter The Mayor declared the motion carried. Trustee Ness was excused at 11:05 a.m. CODE ENFORCEMENT
The Board asked Stan Kimble about several code enforcement issues including the Town's ability to remove junk vehicles from Town property without involvement of the Sheriff's Department, a nuisance ordinance, mobile home regulations, and dangerous animal ordinance. No action was taken. ADJOURNMENT
