Special Meeting

December 15, 2005

CALL TO ORDER

The Board of Trustees of the Town of Deer Trail met in special session on Thursday, December 15, 2005 at the Town Hall, 555 Second Avenue, Deer Trail, Colorado. Mayor Jim Johnson called the meeting to order at 7:02 p.m.

The purpose of the special meeting was to discuss a Cost Recovery Agreement with East Bijou Estates and Municipal Court.

Trustees Present: Gary Lavoie, Russell Ness, Cody Stoumbaugh, Tami Stoumbaugh, Dutch Venter, Melvin Wood

Staff Present: Patti Owens, Town Clerk; Stan Kimble, Town Attorney

COST RECOVERY AGREEMENT

Town Attorney Stan Kimble advised the Board on different aspects of a Cost Recovery Agreement with East Bijou Estates. Glenn Kunkel and John Monnahan participated in the discussion.

TRUSTEE LAVOIE MOVED, TRUSTEE NESS SECONDED to authorize Town Attorney Stan Kimble to begin the process of a Cost Recovery Agreement with East Bijou Estates. Voting was as follows:  YES: Johnson, Lavoie, Ness, C. Stoumbaugh, T. Stoumbaugh, Venter, Wood  NO: None  ABSTAIN: None  ABSENT: None

The Mayor declared the motion carried.

MUNICIPAL COURT

The next step in the Dangerous Building process is to send Summonses to property owners. In order to do that, the Town must have a municipal court in place, preferably a court of record. The Town currently has an ordinance authorizing a municipal court, but needs to appoint a judge. Town Attorney Stan Kimble stated that Dorothy Stone, the municipal judge for Simla and Kiowa, is available to the Town at a cost of $250/visit. The Board authorized Stan to contact Judge Stone and issue summonses in the continuing process to eradicate two of the three previously identified dangerous buildings. The third building has changed ownership and will be demolished.

MAYOR LAVOIE MOVED, TRUSTEE T. STOUMBAUGH SECONDED to adjourn the meeting. The motion carried.

The regular meeting was adjourned at 7:56 p.m.
